1. ACCEPTANCE OF TERMS

By accessing our website (www.elitecustomtattoostudio.com), booking a consultation or appointment, or communicating with Elite Custom Tattoo Studio ("Studio," "we," "us," or "our") through any channel — including SMS, email, phone, or in person — you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. SERVICES

Elite Custom Tattoo Studio provides custom tattoo services, including consultations, design development, and tattoo application, at our studio located at 1075 E South Boulder Rd #125 Suite 207, Louisville, CO 80027. All services are provided to adults 18 years of age and older. Valid government-issued photo ID is required at the time of your appointment. We reserve the right to refuse service to anyone who cannot provide valid identification.

3. APPOINTMENTS AND CONSULTATIONS

Booking: Appointments may be scheduled through our website, by phone, or in person. A deposit may be required to secure your appointment, which will be applied to the total cost of your tattoo service.

Cancellations: If you need to cancel or reschedule, please notify us at least 48 hours in advance. Deposits may be forfeited for cancellations made with less than 48 hours' notice or for no-shows, at the Studio's discretion.

Late Arrivals: Please arrive on time for your appointment. Arrivals more than 15 minutes late may result in rescheduling.

4. SMS MESSAGING TERMS

Elite Custom Tattoo Studio operates two SMS messaging programs:

A. Appointment & Service Messages (Non-Marketing) - These are non-promotional messages including appointment confirmations, booking reminders, schedule changes, deposit receipts, and service-related communications directly related to your tattoo appointment.

B. Marketing Messages - These are promotional messages that may include special offers, flash deals, studio announcements, new artist features, and event notifications.

Opt-In: You may opt into either or both SMS programs by checking the corresponding consent checkbox(es) on our booking or contact forms. Providing your phone number or submitting a form does not constitute consent to receive SMS messages unless you have checked the applicable consent box. Consent is not required as a condition of purchasing any goods or services.

Message Frequency: Message frequency varies. For appointment-related messages, you may receive 1-4 messages per appointment (confirmation, reminder(s), and follow-up). For marketing messages, frequency varies but typically will not exceed 4 messages per month.

Message and Data Rates: Standard message and data rates may apply based on your mobile carrier's rate plan. Elite Custom Tattoo Studio is not responsible for any charges from your mobile carrier.

How to Opt Out: You may opt out of any SMS program at any time by replying STOP to any text message from us. After opting out, you will receive a single confirmation message and no additional messages will be sent. You may re-subscribe at any time by replying START or by contacting us directly.

No Third-Party Sharing: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Your phone number and SMS opt-in status will not be sold, rented, or traded. See our Privacy Policy for full details.

5. DEPOSITS AND PAYMENTS

All deposits are non-refundable unless the Studio cancels the appointment. Accepted forms of payment include cash, credit/debit card, and other methods as posted in the Studio. All prices are subject to change. Final tattoo pricing may vary based on size, complexity, and time required.

6. HEALTH AND SAFETY

You are responsible for disclosing any medical conditions, allergies, or medications that may affect your ability to receive a tattoo. By booking and receiving a tattoo service, you represent that you are in good health and have not consumed alcohol or blood-thinning substances within 24 hours of your appointment. Tattooing carries certain inherent risks including, but not limited to, infection, allergic reactions, and scarring. We follow all applicable health and safety regulations and use sterile, single-use equipment.

7. INTELLECTUAL PROPERTY

All custom tattoo designs created by Elite Custom Tattoo Studio artists are the intellectual property of the Studio and the respective artist. We reserve the right to photograph completed tattoos for portfolio and marketing purposes, unless you explicitly request otherwise in writing before your appointment.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Elite Custom Tattoo Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, website, or SMS communications. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.

9. DISCLAIMER OF WARRANTIES

Our website and services are provided "as is" without warranties of any kind, either express or implied. We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components.

10. GOVERNING LAW

These Terms of Service are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Jefferson County, Colorado.

11. CHANGES TO THESE TERMS

We reserve the right to modify these Terms of Service at any time. Updated terms will be posted on this page with a revised effective date. Continued use of our website or services following any changes constitutes your acceptance of the updated terms.
